Terms of Service

THE SHORT VERSION

  • Online prices are estimates only. Your final price is confirmed after we check your files, and quotes are valid for 15 days.
  • You must own or have permission to use everything in your artwork, including logos, photos and fonts.
  • Please check your proof carefully. Once you approve it, we print exactly what you approved.
  • Custom and large jobs need a deposit (usually 50%). The balance is paid before pickup, delivery or installation.
  • Report any printing defect within 7 days with photos, and we will reprint or refund if the mistake is ours.
  • Unclaimed items may be disposed of 30 days after the job is ready and we have notified you.

1. Who we are and accepting these terms

These Terms of Service (“Terms”) apply to all orders, quotes and services provided by MCAV Tarpaulin Printing Services (“MCAV”, “we”, “us”, “our”), a sole proprietorship owned by Marlon Colina, located at 1077 Hernan Cortes St, Subangdaku, Mandaue City 6014, Cebu, Philippines. They also apply to your use of our website, mcavtarpaulinprinting.com.

By requesting a quote, placing an order, approving a proof, paying a deposit or using our website, you agree to these Terms. If you are ordering for a company or organisation, you confirm that you are authorised to do so on its behalf. If anything in a written quote or agreement signed by us differs from these Terms, the written quote or agreement prevails for that job.

2. Quotes, estimates and pricing

  • Online estimator. The instant tarpaulin price estimator on our website gives an estimate only, VAT inclusive. It is not an offer or a binding quote.
  • Final price. Your final price is confirmed by us after we review your files, sizes, materials, finishing (eyelets, hemming, frames and so on), quantity, delivery and installation requirements.
  • Validity. Unless stated otherwise, quotes are valid for 15 days from the date issued. After that, prices may change because of material or supplier costs.
  • Currency and taxes. All prices are in Philippine Pesos (PHP). Whether a price includes or excludes VAT or other applicable taxes will be stated on your quote or invoice, in line with our registration with the Bureau of Internal Revenue (BIR).
  • Changes. If you change the size, material, quantity, design or schedule after we quote, the price and timeline may change.

3. Your artwork and content

You keep ownership of the artwork, logos, photos and other content you send us. You give us permission to use, copy, edit (for print preparation) and print that content only as needed to complete your order.

By sending us content, you promise that:

  • you own it, or you have all the rights, licences and permissions needed to reproduce it, including trademarks, logos, photos, illustrations, fonts and the names or images of any people shown;
  • it does not infringe anyone’s intellectual property, privacy or other rights; and
  • it is lawful, including under election, advertising and local signage rules where those apply.

You agree to indemnify and hold MCAV harmless from any claims, losses, fines, damages and reasonable legal costs arising from content you supplied or instructed us to print, including claims of copyright or trademark infringement.

We may refuse any job. We may decline or stop work on any content that we reasonably believe is unlawful, defamatory, obscene, hateful, misleading, infringing or otherwise inappropriate. If we refuse a job before production starts, we will refund any amount you paid for it.

4. Design work by MCAV

If we create or lay out a design for you, once the job is fully paid you may use the final design for the purpose it was made for (for example, your tarpaulin, signage or printed materials). Unless agreed in writing:

  • editable source files (such as AI, PSD, CDR or layered files) are not included and remain ours;
  • stock images, templates and fonts we use remain subject to their own licences; and
  • we may show photos of finished work in our portfolio and social media, unless you ask us not to or the job is confidential.

Design fees, the number of included revisions and extra revision charges will be stated in your quote.

5. Proofs and approval

If we prepare or change your layout, we will send you a digital proof for approval before production. If you send print-ready files, we print them as supplied. Either way, it is your responsibility to check the artwork carefully, including:

  • spelling, grammar, names, numbers, dates, phone numbers and addresses;
  • layout, logos, images and overall design; and
  • sizes, orientation, quantity and materials.

Approval is final. Once you approve a proof (by message, email, chat or signature), we will produce exactly what was approved. Errors that appear in an approved proof are your responsibility, and corrections after approval will be charged as a new job.

Colours. Colours on phone and computer screens (RGB) look different from printed colours (CMYK). Your files will be converted to CMYK for printing, and colours may also vary slightly between materials, printers and production batches. We aim for a close match but cannot guarantee an exact colour match to your screen or to previous prints unless a colour-matched proof was agreed.

Size tolerance. Large-format printing and finishing may vary slightly from the ordered size. A tolerance of plus or minus 2% on tarpaulin dimensions is normal and is not a defect.

File quality. We will tell you if we notice that your files are low resolution, but if you ask us to proceed anyway, we are not responsible for blurry or pixelated results.

6. Production and turnaround times

  • Production starts only after any proof is approved and any required deposit is paid.
  • Turnaround times we give are good-faith estimates, not guarantees. They can be affected by the job queue, material supply, weather, power interruptions and changes you request.
  • Rush jobs may be possible for an additional fee, subject to our capacity. We will confirm in writing if we can accept a rush deadline.
  • We are not liable for losses caused by a delay, such as a missed event, but we will keep you informed and do our best to meet agreed dates.

7. Payment

  • Deposit. Custom, large or high-value jobs (including signage, billboards and installation work) usually require a deposit, typically 50% of the quoted price, before production. Small or standard jobs may require full payment upfront.
  • Balance. The remaining balance must be paid before the items are released, picked up or delivered, or as stated in your quote for installation jobs.
  • Payment methods. We accept cash and other methods listed on our website or quote, such as bank transfer and e-wallets. Payments are confirmed only once received in full.
  • Unpaid items. We may hold finished items until full payment is made. Ownership of the items passes to you only once paid in full.
  • Official receipts or invoices will be issued as required by the BIR.

8. Changes and cancellations

You may cancel an order before production starts, and we will refund your deposit less any design work or costs already incurred. Once production has started, you must pay for work already done and materials already used, ordered or cut for your job, and these may be deducted from your deposit. Custom-made items cannot be returned simply because you changed your mind.

9. Pickup, delivery and installation

Pickup

Unless delivery is agreed, finished items are picked up at our shop in Subangdaku, Mandaue City. Please inspect your items at pickup. If items are not claimed within 30 days after we notify you that they are ready, we may dispose of them after giving you a final notice, without refund of any amount paid.

Delivery

Delivery fees depend on location, size and weight and will be stated in your quote. Delivery dates are estimates. Someone must be available to receive and check the items at the delivery address.

Installation

  • You must give our team safe and clear access to the installation site on the agreed date, including any building or mall approvals and access to power where needed.
  • Unless we agree otherwise in writing, you are responsible for obtaining any permits, landlord, homeowners’ association or local government approvals (for example, signage, building or billboard permits).
  • Our quote is based on normal site conditions. If we find unexpected conditions such as weak walls or structures, hidden wiring, unsafe heights or areas, extra work may be needed at additional cost, or we may postpone the installation for safety reasons.
  • Return trips caused by lack of site access, missing permits or site not being ready may be charged.

10. Defects and reprints

If there is a defect caused by us, such as a printing error, wrong material or damage before handover, please report it within 7 days of pickup, delivery or installation, with clear photos and your job number. If we confirm the error was ours, we will, at our option, reprint or repair the affected items, or refund the amount paid for them. We may ask you to return the defective items.

The following are not covered:

  • errors that were present in a proof you approved;
  • low-resolution or poor-quality files you supplied;
  • normal colour variation and the size tolerance described above;
  • damage from misuse, improper handling, storage or installation by others, or alterations;
  • fading, tearing or wear from weather, sun, wind, rain or typhoons beyond normal wear for the material and its expected outdoor life; and
  • issues reported after the 7-day period.

11. Warranty on signage and installation

Any warranty for signage, lighting components, built-up letters, Panaflex, billboards or installation work will be stated in your quote or job order, including what it covers and for how long. If no warranty is stated, only the defect policy in Section 10 applies. Warranties do not cover damage from accidents, vandalism, power surges, natural disasters, unauthorised modifications or repairs by others. Nothing in these Terms limits the rights you have under the Consumer Act of the Philippines (RA 7394) or other laws that cannot be waived.

12. Limitation of liability

To the extent permitted by Philippine law:

  • our total liability for any claim relating to a job is limited to the amount you paid us for that job; and
  • we are not liable for indirect or consequential losses, such as lost profits, lost business, missed events or advertising opportunities.

This does not limit our liability for fraud, gross negligence, wilful misconduct, or anything else that cannot be limited by law.

13. Order tracking

You can check your order status on our website using your job number and the mobile number on your order, without creating an account. Please keep your job number private, because anyone with both your job number and mobile number can view your order status. If you think someone else has your job number, contact us. We may also send order status updates by SMS to the mobile number you gave us.

14. Using our website

When using our website, you agree not to:

  • submit false information or use someone else’s details without permission;
  • upload viruses, malware or files that are not genuine artwork or reference materials;
  • spam our forms, try to bypass our spam protection (Cloudflare Turnstile) or rate limits, or use bots to scrape or overload the site;
  • try to access order information that is not yours, or our admin areas; or
  • use the site for any unlawful purpose.

Website content, our logo and our photos belong to MCAV or our licensors. Prices, product descriptions and photos on the website are for general guidance and may change without notice. Reviews shown from Google and Facebook are the opinions of their authors. We may block access to anyone who misuses the website.

15. Privacy

We handle your personal information in line with the Data Privacy Act of 2012 (RA 10173). Please read our Privacy Policy to learn what we collect and how we use it.

16. Events beyond our control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including typhoons, floods, earthquakes and other natural disasters, power outages or brownouts, internet or supplier failures, fire, government orders, lockdowns, strikes or civil unrest. In such cases we will notify you as soon as reasonably possible and agree on a new schedule. If the delay is long, either of us may cancel the unfinished part of the order, and you will pay only for work done and materials used.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. We encourage you to contact us first so we can try to resolve any concern quickly and fairly. If a dispute cannot be settled, it shall be brought before the proper courts of Mandaue City, Cebu, to the exclusion of other venues, unless the law requires otherwise.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they last changed. The version in effect when you place an order applies to that order.
